On Tuesday, May 22, 2018, the Senate passed Senate Bill 465. On November 29, 2018, the Bill passed the House and was given immediate effect.

Generally speaking, SB 465 amends the Construction Lien Act, to allow architects, engineers, and surveyors to have a construction lien on recording a notice that they have entered into a professional services contract with a landowner, without an actual physical improvement having been made yet on the property. SB 465 establishes procedures under which the liens could be recorded, including liens by a sub-consultant to a design professional.
